By accessing and using GlacierByte Computing's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily access and use the materials (information or software) on GlacierByte Computing's services for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials; use the materials for any commercial purpose or for any public display; attempt to reverse engineer any software contained on GlacierByte Computing's services; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or 'mirror' the materials on any other server.

3. Service Terms

GlacierByte Computing provides enterprise-grade data storage solutions. All services are provided 'as is' with a 99.99% uptime SLA guarantee. We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice to customers.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify GlacierByte Computing of any unauthorized use of your account or any other breach of security.

5. Data Storage and Security

GlacierByte Computing implements industry-leading security measures including AES-256 encryption, multi-factor authentication, and regular security audits. While we take all reasonable precautions to protect your data, you acknowledge that no method of electronic storage is 100% secure.

6. Payment Terms

Payment for services is due according to the billing cycle selected at the time of purchase. All fees are non-refundable except as required by law or as explicitly stated in our service agreement. We reserve the right to modify pricing with 30 days notice.

7. Acceptable Use Policy

You agree not to use our services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our servers or networks. Prohibited activities include but are not limited to: storing illegal content, distributing malware, conducting unauthorized security testing, or engaging in any activity that violates applicable laws.

8. Intellectual Property

All content, features, and functionality of our services, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of GlacierByte Computing Limited and are protected by international copyright, trademark, and other intellectual property laws.

9. Limitation of Liability

GlacierByte Computing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

10. Indemnification

You agree to indemnify and hold harmless GlacierByte Computing, its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

11. Data Retention and Deletion

Upon termination of your account, we will retain your data for 30 days to allow for account recovery. After this period, all data will be permanently deleted from our systems in accordance with our data retention policy and applicable regulations including GDPR.

12. Service Level Agreement (SLA)

We guarantee 99.99% uptime for our services. In the event of service downtime exceeding our SLA, eligible customers will receive service credits as outlined in their specific service agreement. Scheduled maintenance windows and force majeure events are excluded from SLA calculations.

13. Termination

We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will immediately cease.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these terms will be resolved in the courts of Delaware.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on our website and updating the 'Last Updated' date. Your continued use of the service after any such changes constitutes your acceptance of the new Terms.
